Ondar Terms of Service

Welcome to Ondar.

These Terms of Service (“Terms”) govern your access to and use of the Ondar mobile application, website, services, features, content, subscriptions, credits, verification services, events, communications, and related offerings (collectively, the “Service”).

The Service is operated by Waystar Communications LLC, doing business as Ondar (“Ondar,” “we,” “us,” or “our”).

By creating an account, accessing, browsing, downloading, registering for, subscribing to, purchasing, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, whichever is higher, to use Ondar.

By using the Service, you represent and warrant that:

  1. You are at least 18 years old.
  2. You have the legal capacity to enter into these Terms.
  3. You are not prohibited from using the Service under applicable law.
  4. You have not previously been suspended or removed from the Service unless we have given you written permission to return.
  5. You will comply with these Terms and all applicable laws.

We may request age verification at any time. Failure to complete verification may result in restricted access, suspension, or termination.

2. Nature of the Service

Ondar is a social and dating platform designed to help adult users discover and connect with other adult users based on intention, availability, interests, approximate location, plans, groups, and places.

Ondar may include features such as:

Ondar does not guarantee matches, meetings, compatibility, safety, authenticity, availability, relationship outcomes, sexual encounters, friendships, dates, events, or any particular experience.

You are solely responsible for your interactions with other users.

3. Account Registration

To use certain features, you must create an account and provide accurate, current, and complete information.

You agree to:

  1. Keep your login credentials confidential.
  2. Not share, sell, transfer, or assign your account.
  3. Not create multiple accounts to evade moderation, blocking, suspension, or enforcement.
  4. Promptly update your information if it changes.
  5. Accept responsibility for all activity under your account.

We may suspend or terminate accounts that contain false, misleading, incomplete, impersonated, fraudulent, or unsafe information.

4. User Profiles

Your profile may include information such as display name, age, general location, photos, interests, preferences, intentions, availability, identity-related information you choose to provide, and other content.

You agree that your profile must not:

  1. Misrepresent who you are.
  2. Use photos of another person without permission.
  3. Impersonate another person, business, public figure, or organization.
  4. Contain false age, identity, location, or relationship status information.
  5. Promote commercial services, escorting, paid sexual services, pornography sales, solicitation, scams, financial arrangements, or other prohibited activity.
  6. Include hateful, threatening, abusive, illegal, exploitative, or non-consensual content.
  7. Include minors or suggest the involvement of minors in any dating, sexual, or adult context.

We may review, restrict, remove, or require changes to any profile at our discretion.

5. User Content

“User Content” means any content you upload, post, submit, transmit, display, create, share, or otherwise make available through the Service, including photos, messages, profile information, event descriptions, group content, place activity, reports, feedback, and communications.

You retain ownership of your User Content. However, by using the Service, you grant Ondar a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, display, process, transmit, moderate, remove, adapt, and use your User Content as necessary to operate, improve, secure, promote, and provide the Service.

You represent and warrant that:

  1. You own or have the necessary rights to your User Content.
  2. Your User Content does not violate any law or third-party rights.
  3. Your User Content does not violate these Terms.
  4. Your User Content is not false, misleading, harmful, exploitative, or non-consensual.

We are not responsible for User Content posted by users. We may remove or restrict User Content at any time and for any reason, including safety, legal, product, moderation, or community reasons.

6. Acceptable Use

You agree not to use the Service to:

  1. Harass, threaten, stalk, intimidate, shame, dox, blackmail, extort, or abuse any person.
  2. Post or share hate speech, slurs, discriminatory content, or content attacking protected characteristics.
  3. Upload or distribute illegal, exploitative, violent, non-consensual, or abusive content.
  4. Upload, request, transmit, solicit, or engage in any content or activity involving minors.
  5. Misrepresent your age or attempt to interact with minors.
  6. Sell, solicit, broker, advertise, or arrange paid sexual services.
  7. Promote or conduct escorting, trafficking, coercion, or exploitation.
  8. Promote pornography sales, adult paid content, or commercial solicitation unless expressly authorized by Ondar in writing.
  9. Use the Service for scams, phishing, fraud, cryptocurrency schemes, financial manipulation, sugar arrangements, or requests for money.
  10. Send spam, mass messages, bots, automated messages, or unauthorized promotions.
  11. Scrape, crawl, copy, index, reverse engineer, or harvest data from the Service.
  12. Use automation, scripts, bots, fake accounts, or device manipulation.
  13. Circumvent paywalls, verification, moderation, restrictions, suspensions, or bans.
  14. Share another user’s private photos, messages, profile, location, identity, or personal information without consent.
  15. Record, screenshot, distribute, or publish private user interactions in a way that violates privacy, consent, or law.
  16. Use Ondar to organize or promote illegal activity, unsafe public sexual activity, trespassing, or activity in prohibited locations.
  17. Interfere with the security, functionality, availability, or integrity of the Service.
  18. Use the Service in a way that violates applicable law, these Terms, or our community standards.

7. Adult Content and Sexual Content

Ondar is intended for adults only. The Service may allow certain adult-oriented expression, flirting, dating-related communication, and consensual adult interaction where permitted by law and our policies.

However, you may not upload, share, request, distribute, or promote content that is illegal, exploitative, non-consensual, coercive, abusive, commercial sexual solicitation, involving minors, involving incapacitated persons, or otherwise prohibited by these Terms.

Ondar may restrict, blur, moderate, remove, or prohibit explicit content in certain areas of the Service, including public profiles, Places, Events, Club Mode, app store-compliant surfaces, or other areas.

Private content is still subject to these Terms and may be reviewed if reported, flagged, or required for safety, moderation, legal, or compliance reasons.

8. Location Features

Ondar may use location-related information to help users discover nearby people, plans, events, places, neighborhoods, and activity zones.

To protect privacy and safety, Ondar may use approximate location, neighborhood-level location, distance ranges, or obfuscated location rather than exact address-level location.

You agree that:

  1. You will not use location features to stalk, track, identify, harass, or harm another person.
  2. You will not attempt to determine another user’s exact location without consent.
  3. You will not publicly post another user’s address, hotel room, workplace, home, or exact location.
  4. You are responsible for deciding whether, when, and with whom to share your precise location.

Location-based services can involve risks. Use judgment when meeting others and consider using the Safety Check-In feature.

9. Now Events, Group Events, and Places

Ondar may allow users to create, browse, join, request access to, or interact with plans, events, group activities, and places.

You are solely responsible for any event or plan you create, attend, host, or join.

You agree not to create or promote events that:

  1. Involve illegal activity.
  2. Involve minors.
  3. Involve coercion, trafficking, exploitation, or paid sexual services.
  4. Encourage unsafe, non-consensual, or public illegal sexual activity.
  5. Take place in prohibited, unsafe, restricted, non-consenting, or trespassed locations.
  6. Misrepresent the nature, rules, host, location, attendees, or expectations of the event.
  7. Violate venue rules, local laws, property rights, or community safety.

Ondar is not the host, organizer, sponsor, guarantor, or operator of user-created events unless expressly stated in writing.

We may remove, restrict, review, cancel, or limit events or Places-related activity for any reason, including safety, legal, moderation, product, or community quality reasons.

10. Club Mode

Club Mode is a curated premium experience within Ondar.

Access to Club Mode may require a paid subscription, completed profile, verification, photo standards, age verification, community standing, and compliance with Ondar policies.

Club Mode approval is not guaranteed. We may approve, deny, revoke, pause, or limit Club Mode access at our discretion.

Club Mode eligibility may consider factors such as:

  1. Account authenticity.
  2. Completed profile.
  3. Photo quality and authenticity.
  4. Verification status.
  5. Clear intentions.
  6. Community standing.
  7. Safety history.
  8. Report history.
  9. Spam or commercial behavior.
  10. Compliance with these Terms.

Club Mode is not a guarantee of attractiveness, compatibility, safety, trustworthiness, behavior, availability, or any particular outcome.

11. Verification and Verified+

Ondar may offer verification features, including identity-related, age-related, selfie, photo, account, or trust verification.

Verification may be free, paid, included in a subscription, or available as Verified+.

Verification does not guarantee that a user is safe, truthful, compatible, available, or free from risk. It only indicates that the user completed certain verification steps as determined by Ondar.

You agree not to submit false, altered, misleading, stolen, AI-generated, or unauthorized verification materials.

We may deny, revoke, or repeat verification at any time.

12. Safety Check-In

Ondar may provide safety tools such as Safety Check-In, trusted contact sharing, safety timers, profile sharing, approximate location sharing, and reminders.

These tools are designed to support safer decision-making but do not guarantee your safety or replace emergency services.

Ondar is not an emergency response provider. If you are in immediate danger, contact local emergency services.

You are responsible for:

  1. Choosing whether to meet another user.
  2. Choosing the location and timing of any meeting.
  3. Telling trusted people where you are going.
  4. Using available safety tools.
  5. Exercising caution, especially with new people, private locations, travel, alcohol, substances, or group events.

13. Blocking, Reporting, and Moderation

Ondar provides tools to block users, report users, report content, and report safety concerns.

We may review reports, User Content, account activity, metadata, device signals, verification materials, messages, events, or other information where permitted by law and necessary for safety, moderation, legal compliance, enforcement, or product integrity.

We may take actions including:

  1. Warning a user.
  2. Removing content.
  3. Restricting features.
  4. Limiting visibility.
  5. Suspending or terminating an account.
  6. Revoking Club Mode.
  7. Revoking verification.
  8. Blocking devices or payment methods.
  9. Referring matters to law enforcement where appropriate.
  10. Taking no action if we determine no violation occurred.

We do not guarantee that moderation will identify or prevent all harmful conduct.

14. Subscriptions

Ondar may offer paid subscriptions, including Ondar Plus, Club Mode, Host/Groups Add-On, or other plans.

Subscription features, prices, billing periods, trials, renewals, and cancellation rules will be disclosed at the point of purchase.

Subscriptions may automatically renew unless canceled before the renewal date through the applicable app store, payment provider, or account settings.

If you purchase through Apple App Store or Google Play, your purchase is processed by the applicable store and subject to that store’s payment terms, refund rules, and cancellation procedures.

We may change subscription features, prices, or availability, subject to applicable law and platform rules.

15. Credits and Consumable Purchases

Ondar may offer credits or other consumable digital items that can be purchased or earned and used for features such as boosts, event promotion, spotlights, priority interest, travel visibility, private photo unlocks, or other in-app features.

Credits:

  1. Have no cash value.
  2. Are not legal tender.
  3. Are not transferable unless expressly allowed by Ondar.
  4. May not be sold, exchanged, assigned, or redeemed for money.
  5. May expire where permitted by law and disclosed to you.
  6. May be revoked in cases of fraud, chargebacks, abuse, technical error, or violation of these Terms.

Purchasing credits does not guarantee matches, messages, meetings, profile views, event attendance, or any particular outcome.

16. Payments and Refunds

All payments must be made through approved payment methods.

Except where required by law or by applicable app store rules, payments are non-refundable.

We may refuse, reverse, cancel, or suspend transactions in cases of suspected fraud, abuse, unauthorized payment, chargeback, technical error, or violation of these Terms.

For purchases made through Apple App Store or Google Play, refund requests must generally be handled through the applicable platform.

17. Promotions, Founding Memberships, and Beta Offers

Ondar may offer limited promotions, founding memberships, beta access, trials, discounted pricing, invite programs, or early access offers.

Such offers may be limited by time, location, eligibility, availability, platform, or other criteria.

We may modify, pause, or end promotions at any time, subject to applicable law.

Founding, early access, or beta status does not guarantee permanent access to any specific feature, price, badge, benefit, or version of the Service unless expressly stated in writing.

18. Privacy

Your use of Ondar is also governed by our Privacy Policy.

Because Ondar may involve sensitive categories of information, including dating preferences, LGBTQ+ community participation, location-related data, private photos, verification, and messaging, you should review the Privacy Policy carefully.

We design Ondar with a privacy-first approach, including approximate location, safety controls, and user-managed visibility options. However, no system is completely secure, and you should be careful with information you choose to share.

19. Intellectual Property

The Service, including the Ondar name, logo, brand, design, software, interface, features, text, graphics, icons, trademarks, service marks, trade dress, content, systems, and technology, is owned by Ondar or its licensors and protected by intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, scrape, reproduce, or create derivative works based on the Service except as expressly permitted by us in writing.

20. Feedback

If you provide ideas, suggestions, feedback, bug reports, concepts, feature requests, or other input, you grant Ondar a worldwide, perpetual, irrevocable, royalty-free license to use, modify, implement, commercialize, and exploit that feedback without compensation to you.

21. Third-Party Services

The Service may integrate with third-party services, including payment processors, app stores, analytics providers, cloud hosting, verification providers, mapping services, messaging infrastructure, and safety tools.

We are not responsible for third-party services, and your use of them may be subject to their own terms and privacy policies.

22. Assumption of Risk

You understand and agree that meeting people online and offline involves risk.

You are solely responsible for your interactions with other users, including decisions to communicate, share information, exchange photos, meet, travel, host, attend events, or participate in group activities.

Ondar does not conduct criminal background checks on all users unless expressly stated. Even where verification, moderation, or safety features are used, Ondar cannot guarantee user conduct or safety.

Use caution and good judgment.

23. Disclaimers

The Service is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Ondar disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, security, compatibility, and uninterrupted operation.

We do not warrant that:

  1. The Service will be error-free or uninterrupted.
  2. Users are who they claim to be.
  3. User Content is accurate or lawful.
  4. You will find matches, dates, friends, partners, events, or compatible people.
  5. The Service will prevent all harmful, unsafe, fraudulent, or abusive conduct.

24. Limitation of Liability

To the fullest extent permitted by law, Ondar and its owners, officers, directors, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, punitive, exemplary, or enhanced damages, including lost profits, lost data, emotional distress, reputational harm, personal injury, loss of goodwill, or business interruption.

To the fullest extent permitted by law, Ondar’s total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of:

  1. The amount you paid to Ondar in the twelve months before the claim; or
  2. One hundred U.S. dollars (US $100).

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

25. Indemnification

You agree to defend, indemnify, and hold harmless Ondar and its owners, officers, directors, employees, contractors, agents, affiliates, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

  1. Your use of the Service.
  2. Your User Content.
  3. Your interactions with other users.
  4. Your events, plans, hosting, or attendance.
  5. Your violation of these Terms.
  6. Your violation of law.
  7. Your violation of another person’s rights.
  8. Your fraud, misrepresentation, misconduct, negligence, or intentional wrongdoing.

26. Termination

You may stop using the Service at any time.

We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, for any reason, including:

  1. Violation of these Terms.
  2. Safety concerns.
  3. Fraud or abuse.
  4. Legal compliance.
  5. Platform integrity.
  6. Harm to other users.
  7. Inactivity.
  8. Product changes or discontinuation.

Termination may result in loss of access to your account, profile, messages, content, subscriptions, credits, Club Mode, verification, and other features.

Certain provisions of these Terms will survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and any provisions that by their nature should survive.

27. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles, unless applicable consumer protection laws require otherwise.

28. Dispute Resolution and Arbitration

Please read this section carefully. It may require you to arbitrate disputes with Ondar and limit the manner in which you can seek relief.

Before filing a claim, you agree to first contact us at legal@ondar.co and attempt to resolve the dispute informally.

If the dispute is not resolved within 30 days, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration, except for claims that may be brought in small claims court or claims seeking injunctive relief for intellectual property misuse, unauthorized access, or abuse of the Service.

The arbitration will be conducted in Miami-Dade County, Florida, unless otherwise required by applicable law, before a single arbitrator under the rules of the American Arbitration Association (AAA).

You and Ondar agree to waive the right to a jury trial and to participate in a class action, class arbitration, collective action, or representative proceeding to the fullest extent permitted by law.

If this arbitration provision is found unenforceable, disputes will be resolved in the state or federal courts located in Miami-Dade County, Florida, unless applicable law requires otherwise.

29. Changes to the Terms

We may update these Terms from time to time.

If we make material changes, we may notify you by email, in-app notice, website notice, or other reasonable means.

Your continued use of the Service after changes become effective means you accept the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service.
